Learner Terms and Conditions

1. Definitions
1.1. In these Conditions the following terms shall have the following meaning:

Accredited Course Provider means IMECH INSTITUTE PVT. LTD.

An application form refers to the document you fill out and submit to IMECH when you’re applying to enroll or register for a Qualification or Assessment with them.

IOSH Training Agreement means the form and submitted by You to IMECH when You apply to enroll or register for a Qualification or Assessment with IMECH ,

Conditions means these IMECH INSTITUTE General Terms and Conditions for Students,

Enrolment Fee means the fee payable by You when You apply to become a candidate of IMECH INSTITUTE,

IOSH stands for the Institution of Occupational Safety and Health. It’s a professional body for health and safety practitioners. IOSH Services Limited, with the company registration number 1816826, is associated with IOSH. Their address is The Grange, Highfield Drive, Wigston, Leicestershire, LE18 1NN

Malpractice Policy refers to the most recent policy concerning malpractice, which may be updated or modified periodically.

Assessments refer to evaluations of practical units and/or examinations that contribute to your final qualification.

Policies refer to the set of rules and guidelines established by IMECH Institute and Awarding Bodies, which may be amended, updated, or supplemented periodically..

Registration Fee is the fee you need to pay when you register to undertake a specific Qualification/Assessment with IMECH Institute.

Scripts means the document containing Your answers to Assessments,

Awarding Body means NEBOSH, IOSH or other organisations providing accreditation for Qualification’s to IMECH INSTITUTE.

2. Scope of Terms and Conditions

2.1. These Conditions govern Your relationship with IMECH INSTITUTE and the Awarding Body which may come into force through any registration or enrolment You commit to through IMECH INSTITUTE . For the avoidance of any doubt Awarding Bodies are not responsible for the provision of teaching, tutorial or other such services at any venue or centre.
2.2. These terms outline the fundamental obligations of IMECH Institute and your responsibilities, including but not limited to fees and payments.
2.3. Upon enrolling in a study program for your qualification, your agreement for that program is with IMECH Institute. The Awarding Body is not involved in this agreement.
2.4. If the examinations for the qualification are conducted by the institution issuing the diploma/certificate, IMECH Institute bears no responsibility for the examination process. The relevant examination institution is responsible for its conduct.

3. Payment of Fees
3.1. Course fees charged by IMECH Institute are subject to GST (Goods and Services Tax).
3.2 You may also be responsible for additional fees (including but not limited to mark review fees, registration fees, renewal fees, and additional administration fees) which may not be outlined in your contract with IMECH Institute or the Awarding Body. Any additional charges imposed by your bank or money transfer provider must be covered by you. If such fees are deducted from the amount paid to us, we will invoice you for the deducted amount, which must be paid in full.
3.3 The outstanding balance of your fee must be cleared in full before you can register for trainings.
3.4 All exam fees expire after 12 months if not utilized.

4 – Discounts
Announcements regarding discounts on tuition fees are communicated promptly through various communication channels.

5. Enrolment, Transfer, Refund and Cancellation

5.1 By enrolling for a qualification with IMECH Institute you acknowledge and accept these Conditions.
5.2. Your enrollment with IMECH Institute will be considered effective only upon receipt of the official enrollment receipt from IMECH Institute and upon full payment of the Enrolment Fee and any other specified fees.
5.3. Enrollment serves the purpose of identifying you to IMECH Institute, tracking your progress through qualifications, confirming your eligibility for participation in Awarding Body Assessments, and verifying previously attained units that contribute to Awarding Body qualifications.
5.4. By enrolling for a qualification, you agree to adhere to the regulations set forth by the respective Awarding Bodies for that qualification.
5.5. Qualifications, whether in part or in whole, are non-transferable to another party.
5.6. No refunds will be provided for courses that have been partially or fully completed.
5.7 In the event that a candidate is unable to take the exam(s) due to illness, and upon approval of the medical doctor’s report by the accreditation institution, a 20% refund of the exam fee determined by the relevant institution will be issued to the candidate for the canceled exam(s). Refunds will not cover any additional costs incurred by the candidate. All refund requests must be submitted no later than one calendar month following the examination(s).
5.8 The learner has the right to cancel the purchase for a limited period of time upto 5 working days only provided the software has not been accessed (logged in) by the user.
5.9 E-Learning courses must be finished within three weeks from the date of deposit payment. If the course is not completed within this timeframe, it will be canceled, and the deposit will not be refunded.

6. Course Material
6.1. The materials you receive when you start your program are designed and approved by IOSH. Together with any extra materials given during your studies and the trainer support, they contain all the information you need to complete your program successfully.
6.2. Each enrolment is for a single user only. On registration, you will be issued with the login credentials User id and password. You are responsible for all use of the Services using Your ID and for preventing unauthorised use of Your ID for e-learning platform.
6.3. The price quoted to You or stated within our brochures and or website(s) is correct at the time of publication and is subject to change at any time.
6.4. You’ll have access to e-learning resources, including training notes and videos, for a period of six months.

8. Eligibility for study
8.1 IMECH Institute offers qualifications delivered and examined only in English.
8.2 For English qualifications, it’s your responsibility to ensure your proficiency in both written and oral English is adequate for your studies and exams.
8.3 IMECH Institute reserves the right to reject examination registrations if you do not meet IMECH Institute’s criteria.

9. Reasonable Adjustments
9.1. It is Your responsibility to ensure You have registered for the appropriate examination, date and venue. IMECH INSTITUTE cannot be held responsible for mistakes.
9.2. You have the right to apply for reasonable adjustment should You feel You will be at a disadvantage during Your Assessment.
9.3. Your application for reasonable adjustment must be accompanied by substantiated evidence of Your disadvantage.
9.4. Your application for reasonable adjustment must be sent to, email: admin@imech.in, and must be received by IMECH Institute 10 (ten) days prior to Your selected examination registration closing date.

10. Assessments for registration
10.1. When registering for assessment to a qualification You are agreeing to abide by the regulations for that assessment, as set out in the IOSH “Guide” to that qualification.
10.2. Fees and registrations are not transferable to alternative examinations or later examination sittings, or between candidates.

11. Liability for IMECH INSTITUTE
11.1. IMECH Institute excludes liability for:
11.2.1. Any damage or loss to property, unless caused by the negligence of IMECH Institute or its employees.
11.2.2. Any loss of profit, earnings, opportunity, living expenses, or any other indirect loss suffered by you due to breach of obligation by IMECH Institute, or due to any act, omission, or negligence of IMECH Institute or its employees or agents.
11.3. Neither you nor IMECH Institute shall be liable to each other for any failure or delay in the performance of obligations due to any cause beyond the reasonable control of the relevant party.

12. Termination
IMECH Institute may terminate Your enrolment or registration at any time by written notice if:
12.1 You breach these Conditions or any terms and conditions contained in any letter confirming Your enrolment or any documents or Policies issued by IMECH Institute or the Awarding Body at any time, or
12.2 You fail to pay any fees due to IMECH Institute , or
12.3 You have provided IMECH Institute whether through a third party or otherwise with any false or misleading information, or
12.4 You do not meet all of the administrative or academic requirements specified in the Guides issued by the Awarding Body, or
12.6 You are involved in any malpractice pursuant to the Awarding Bodies Malpractice Policy. 12.7. Should IMECH Institute terminated Your learning programme there will be no refund of any funds paid.

13. Physical and or verbal Abuse
IMECH Institute will not tolerate verbal or physical abuse of its employees. Any such incident of abuse may lead to: a) restriction of communications with You to a specified means e.g. via email or b) in cases which IMECH Institute , at its sole discretion, considers to be serious or in repeated cases of physical or verbal abuse, termination of enrolment and / or registration with IMECH Institute and the Awarding Body, and / or exclusion from future enrolment or registration with IMECH Institute and the Awarding Body.

14. Intellectual Property Rights (IPR)

14.1. All copyright and intellectual property rights in course materials purchased from IMECH Institute remain with IMECH Institute. These materials cannot be reproduced, copied, or distributed without IMECH Institute’s prior written consent or as required by law.
14.2. When accessing IMECH Institute’s website, you must adhere to IMECH Institute’s terms of use. It’s your responsibility to keep your password and user account information secure and not disclose it to any third party.

15. Data Protection Act.
IMECH Institute is committed to protecting and respecting the confidentiality of sensitive information relating to staff, students, visitors and other organization that we are associated with. We comply with the law & whatever information is collected will be used fairly, stored safely and not disclosed to any other person unlawfully. The following are the steps we follow:

1. Data is processed fairly and lawfully.
2. Data is obtained only for lawful purposes, and is not further used in any manner incompatible with those original purposes.
3. Data is accurate and, where necessary, kept up to date.
4. Data is adequate, relevant and not excessive in relation to the purposes for which it is processed.
5. Date is not kept for longer than is necessary for those purpose.
6. Data is processed in accordance with the rights of data subjects.
7. Data is protected by appropriate technical and organizational measures against unauthorized or unlawful processing and against accidental loss, destruction or damage.
All staff who process or use personal information must ensure that they follow these principles at all times. In order to ensure that this happens, the institute has developed this data protection policy. This policy does not form part of the contact of employment for staff, but it s a condition of employment that employees will abide by the rules and policies made by the institute from time to time. Any failure to follow the policy can therefore result in disciplinary proceedings.

Plagiarism Policy
As a training institute, it’s our responsibility to ensure that students receive fair and accurate assessments of their work. Plagiarism is a serious issue because it involves students using someone else’s work and claiming it as their own. This undermines the credibility of qualifications for everyone involved, including the student, the training provider, and the awarding body. Plagiarism can occur when students don’t properly acknowledge sources of information or ideas that they’ve used in their work. To avoid plagiarism, students need to give clear credit whenever they use someone else’s ideas, opinions, statistics, or written or spoken words.

What is plagiarism?
Plagiarism is when someone uses another person’s ideas, words, or work and presents them as their own without giving proper credit or acknowledgment. It can involve copying text directly, paraphrasing someone else’s ideas without citation, or even using someone else’s creative work without permission.
Responsibilities

It’s the student’s responsibility to guarantee that the work they submit for assessment is their original work and to properly reference any contributions from third parties. It’s the duty of assessment staff and examiners to emphasize to students that both our institution and the awarding bodies have a zero-tolerance policy towards plagiarism. Any detected instances of plagiarism will be thoroughly investigated, and students will be informed of the consequences should they fail to adhere to the policy.

Preventative action

To minimize the risk of plagiarism, it’s important to take proactive steps such as modifying assessment plans and personalizing them. This can include conducting examinations in person at the institute or via video call, depending on the circumstances and requirements of the assessment.
Investigation
Evidence of plagiarism must be collected meticulously and kept confidential. All documents pertaining to a suspected case must be preserved and stored securely. It’s essential that the investigator ensures there is clear evidence demonstrating plagiarism in all cases.

Therefore the following must be considered:
Was the outcome of the qualification changed by the plagiarism? If so then the assessment should be taken again.
If the plagiarism was minor and did not appear to be intentional cheating then guidance and support should be given to the student to overcome this.
If the plagiarism takes the form of copying and pasting material from a resource such as the internet the student must be made aware that this is unacceptable and must be advised to resubmit.
If the student fails to understand it should be questioned as to whether the course is suitable for them or whether the assessment instructions are clear.

Outcome
If plagiarism is confirmed after a thorough investigation, the candidate must be notified of the consequences. Depending on the qualification, this could involve resubmitting evidence, nullifying an examination result, or retaking an examination.

Appeals

If the candidate disputes the allegation, they have the right to appeal to the awarding body. Details of the appeal procedure of the individual awarding body should be provided to the candidate as soon as possible, and both parties should adhere to their guidelines.
